This article will focus more to the owners than field personnel, as owners are responsible for providing adequate insurance.

If any of your future projects involve using products such paints, urethanes, MMA’s, and epoxies that are less than 100% solids and create VOC’s (volatile organic compounds), you have to do more than just provide the proper ventilation and PPE (personal protective equipment) for your crew.

Should any of the odors become offensive (headaches, nausea etc.) to people in surrounding areas or business, or causes damage to any products, you can be held liable. Now most contractors I believe would think any type of claim such as this would be covered under the Contractor’s General Liability policy, but IT MAY NOT BE. Insurance advisors recommend purchasing a POLLUTION RIDER. This is additional coverage that protects from the “air pollution” these odors are considered.

Personally I have seen cases where a 55% CRU (chemical resistant urethane) was mixed, the fumes traveled through the plant causing an evacuation, sick employees, and the entire kitchen having to be professionally cleaned and sanitized plus all the food not in coolers had to be destroyed, a very large claim!

Play it safe! If you are using anything less than 100% solids, -0- VOC products check with your insurance professional.
